Sole Mandate Promotion — Terms & Conditions
1. Seller Reward
1.1 Every seller who grants Upton Properties a qualifying sole mandate and who successfully sells their property through Upton Properties during the mandate period will receive a Twelve Apostles Hotel & Spa voucher package valued at R25,000.
1.2 To qualify for the Seller Reward:
a) A sole mandate must be signed with Upton Properties between 1 June 2026 and 30 September 2026 (both dates inclusive).
b) The sole mandate period must be a minimum of eight (8) consecutive weeks.
c) The agreed commission rate must be no less than 4.5% plus VAT.
d) A written offer to purchase must be accepted during the sole mandate period or any renewal thereof.
e) Registration of transfer must be successfully completed.
1.3 Should the sole mandate expire and subsequently be renewed with Upton Properties, the seller shall remain eligible for the Seller Reward provided all other qualifying criteria are met.
1.4 The voucher becomes redeemable only upon successful registration of transfer.
1.5 Only one voucher will be awarded per property, irrespective of the number of registered owners.
1.6 The voucher may not be exchanged for cash, commission discounts or alternative benefits.
1.7 There is no limit on the number of Seller Rewards that may be awarded during the Promotion period.
2. Promotional Draw
2.1 In addition to the Seller Reward, Upton Properties will award one further Twelve Apostles Hotel & Spa voucher package valued at R25,000 by means of a promotional draw.
2.2 The draw is open to all sellers who grant Upton Properties either a sole mandate or an open mandate between 1 June 2026 and 30 September 2026 (both dates inclusive).
2.3 To qualify for the draw, the agreed commission rate on the mandate must be no less than 4.5% plus VAT.
2.4 Each qualifying property shall receive one entry into the draw.
2.5 A seller is not required to sell their property in order to enter or to win the draw. Entry is earned upon signing a qualifying mandate.
2.6 Sellers who receive the Seller Reward shall also remain eligible for the draw.
Exclusions
2.7 The following persons are not eligible to enter the draw: the directors, employees,and agents of Upton Properties, together with the spouses, life partners and immediate family members of such persons.
Independent supervision
2.8 The draw will take place on 13 October 2026 at the offices of STBB Smith Tabata Buchanan Boyes in Claremont, under independent supervision, and the result will be certified accordingly.
Notification and announcement
2.9 The winner will be notified using the contact details recorded on the mandate agreement, and the winner’s name will be published on the Upton Properties website in the interests of transparency. By entering the draw, the seller consents to their name being published in this manner should they be the winner.
2.10 Only one promotional draw prize will be awarded.
3. Eligible Properties and Areas
3.1 Participation in the Promotion is available only for properties accepted by Upton Properties.
3.2 Eligible suburbs and geographic areas shall be determined at the sole discretion of Upton Properties.
4. Bookings
4.1 All voucher bookings must be made directly with Jennifer (jen@rchmail.co.za) or Johan (johan@rchmail.co.za).
4.2 Guests must advise that they are redeeming the “Upton Properties Twelve Apostles Voucher Prize”.
4.3 Upton Properties accepts no responsibility for hotel availability, booking amendments, cancellations or changes made by the hotel.
5. Promotion Period
5.1 The Promotion applies to qualifying mandates signed between 1 June 2026 and 30 September 2026, both dates inclusive.
6. The Prize
6.1 Each prize consists of a Twelve Apostles Hotel & Spa voucher package valued at R25,000.(Twenty Five Thousand Rand)
6.2 The voucher package includes:
• Two-night stay in a Luxury Room for two people, including breakfast.
• One pre-dinner cocktail per person in the Leopard Bar.
• One three-course dinner for two from the Dinner/Movie Menu in Azure Restaurant, including a cinema screening and sweet treats.
• One bottle of the sommelier’s selected wine served during dinner.
• One Twelve Apostles Touch Spa Treatment for two people together (105 minutes).
6.3 Voucher validity: until 19 December 2026; and from 6 January 2027 until 19 December 2027.
6.4 The package remains subject to availability and the hotel’s prevailing booking policies.
7. Protection of Personal Information
7.1 Personal information collected in connection with the Promotion will be used only for the purpose of administering the Promotion, in accordance with the Protection of Personal Information Act, 2013 (POPIA).
7.2 As set out in clause 2.9, the winner consents to the publication of their name on the Upton Properties website.
8. General
8.1 The voucher is not transferable, save that Upton Properties may, at its sole discretion and upon written request, permit transfer to an immediate family member.
8.2 Upton Properties accepts no responsibility for any loss, injury, damage or expense arising from the use of the prize.
8.3 Upton Properties reserves the right to amend, suspend or withdraw the Promotion at any time, provided that no such change shall prejudice the rights of a seller who has already qualified for the Seller Reward or entered the draw.
8.4 These Terms and Conditions are available free of charge on request and on the Upton Properties website.
8.5 The Promotion and these Terms and Conditions are governed by the laws of the Republic of South Africa.
8.6 By participating in the Promotion, sellers agree to be bound by these Terms and Conditions.
8.7 In the event of any dispute relating to the Promotion, including the draw, the decision of Upton Properties shall be final.
8.8 This Promotion is limited to one Seller Reward and one draw entry per qualifying property.
